1. INTRODUCTION

The Lesotho Communications Authority (Licensing Classification and Fees) Rules, 2018 were tabled by the Honourable Minister of Communications, Science and Technology before the House on Friday, 20th April, 2018. Pursuant to Standing Order No. 100 (3), the Subordinate Law was referred to the Portfolio Committee on the Prime Minister’s Ministries and Departments Cluster (Annex 1) for consideration.
The Ministry was subsequently invited to provide the Committee with all the necessary information relating to the policy context, financial implications, contents and effects of the Subordinate Law as per Standing Order No. 101 (2).
The report presents a summary of the Committee’s deliberations on the Rules and recommendations.

  1. MINISTERIAL BRIEF ON THE SUBORDINATE LAW
    The Hon. Minister of Communications explained that the Rules are reviewed at the interval of five years in order to strike a balance between technological developments and regulatory stability. He added that the Subordinate Law is therefore intended to repeal the Lesotho Communications Authority (Licensing Classification and Fees) Rules, 2013.
    He indicated that the Rules are intended to establish classes of licenses and fees payable by all licensees in the communications sector. He further highlighted that the Rules seek to facilitate the availability of reliable, affordable and easily accessible communications services throughout the country.
  2. FINANCIAL IMPLICATIONS It was mentioned that the implementation of the Rules will not have any financial bearing on the part of the Government.
  3. CONCLUSION AND RECOMMENDATIONS After a thorough deliberation on the Rules and consideration of the ministerial brief, the Committee resolved to submit this report to the House for adoption and recommends that the Lesotho Communications Authority (Licensing Classification and Fees) Rules, 2018 be allowed by the House.
